Under the NJ Uniform Construction Code (N.J.A.C. 5:23) and the 2018 International Swimming Pool and Spa Code adopted in New Jersey, every residential swimming pool in Newark must be completely enclosed by a barrier. The top of the barrier must be at least 48 inches above grade measured on the side facing away from the pool, maintained around the entire perimeter and for a distance of 3 feet measured horizontally from the outside of the barrier. Openings in the fence must be small enough to prevent passage of a 4-inch-diameter sphere. For chain-link fencing, the maximum opening is 1-3/4 inches. The gap between the bottom of the fence and the ground cannot exceed 2 inches. For mesh fencing, the bottom clearance must not exceed 1 inch above the deck, and the fence must not be liftable more than 4 inches from grade. Pedestrian access gates must open outward away from the pool, be self-closing, and have a self-latching device. The latch mechanism must be positioned at least 54 inches above the ground to keep it out of reach of small children. If the latch release is below 54 inches, it must be on the pool side at least 3 inches below the top of the gate. The dwelling wall may serve as part of the barrier if doors opening to the pool area have self-closing devices and alarms. The federal Virginia Graeme Baker Pool and Spa Safety Act requires compliant anti-entrapment drain covers on all pool and spa suction outlets.
