A residential hot tub or spa with a safety cover meeting ASTM F1346 is exempt from the pool barrier requirement under the Residential Code of Ohio. Public spas are licensed and inspected by Summit County Public Health under OAC 3701-31 as public swimming pools.
For private residential spas and hot tubs, Appendix AG of the Residential Code of Ohio exempts a spa or hot tub from the enclosure/barrier rules if it is equipped with a safety cover complying with ASTM F1346. Without such a cover, the 48-inch barrier requirement applies. Local building departments enforce this. Public spas are treated as public swimming pools: Ohio rule 3701-31-01 defines a 'public spa' as a public swimming pool operated as a smaller (under 5,000 gallons), higher-temperature (over 90 degrees Fahrenheit) pool for recreational or nonmedical use, licensed and inspected by Summit County Public Health.
Public spa violations are enforced by SCPH under ORC 3749 (license suspension/closure). Residential barrier/cover violations are enforced by local building departments.
