The Virginia Uniform Statewide Building Code (13VAC5-63) adopts the 2021 IRC, including Section AG105 (pool and spa barriers) and ASTM F1346-91 (Standard Performance Specification for Safety Covers and Labeling Requirements for All Covers for Swimming Pools, Spas and Hot Tubs). Under this framework, a hot tub or spa equipped with a listed, locked F1346 safety cover is exempt from the 48-inch perimeter barrier fence that otherwise applies to residential pools. Richmond Planning and Development Review follows USBC without local amendment on this point. A 240-volt hardwired spa requires an electrical permit and GFCI-protected disconnecting means within sight but not less than 5 feet from the spa edge (NEC 680.12). A 120-volt cord-and-plug spa rated less than 50 amps is permitted under NEC 680.43 and typically does not require a building permit if water depth is under 24 inches. Resource Protection Area (RPA) siting within 100 feet of the James River and Chesapeake Bay tributaries requires additional stormwater review. Richmond HOAs may impose fencing or screening standards beyond the state exemption.
