Every public, semi-public, hotel, club, HOA, and rental swimming pool in DuPage County must be licensed and inspected by the DuPage County Health Department under the Illinois Swimming Facility Act (210 ILCS 125) and Illinois Department of Public Health Swimming Facility Code (77 Ill. Adm. Code 820). Rules cover supervision, water quality, signage, and emergency equipment. Private single-family pools are exempt.
The DuPage County Health Department's Environmental Health Services Division is the local enforcement agency for the Illinois Swimming Facility Act (210 ILCS 125) and the Illinois Department of Public Health Swimming Facility Code at 77 Ill. Adm. Code Part 820. The Act and rules apply to every "swimming facility" open to the public or to defined user groups: hotel and motel pools, apartment-complex and condominium pools, HOA pools, fitness-club pools, school and camp pools, public park pools, and any pool offered for rental. A purely private single-family residential pool is not a "swimming facility" under the Act and is regulated only by the DuPage County Building Code's barrier rule (Sec. 8-1300). For regulated facilities, the County Health Department reviews construction plans before opening, issues annual operating licenses, performs routine and complaint inspections, and orders closure when violations endanger health or safety. Inspections check free chlorine residual (1.0β4.0 ppm typical), pH (7.2β7.8), water clarity, daily operator log entries, posted depth markings, posted maximum bather load, presence of a Certified Pool Operator, rescue equipment, emergency telephone, and barrier compliance.
Operating a regulated pool without a current DuPage County Health Department license is a violation of 210 ILCS 125/13 and 77 Ill. Adm. Code 820. The County may close the facility immediately, deny re-licensure, and pursue administrative penalties. Each day of unlicensed operation is a separate offense.
