Under Allen County Code 10-5-13, all public pools must be supervised by a capable person responsible for compliance, who arranges annual lifeguard training. All public pools, and semi-public pools with at least 2,000 square feet of water surface, must have lifeguards on duty at poolside at all times when open (10-5-13-2). Lifeguards must hold current lifeguarding, CPR, bloodborne-pathogen, and first-aid certification. Water depth must be plainly marked at or above the surface (10-5-10), and where no lifeguard is provided, a sign reading "WARNING β NO LIFEGUARD ON DUTY" in letters at least four inches high is required. Serious incidents must be reported to the Department within ten days.
Operating a pool contrary to the ordinance is a declared common nuisance; on conviction, a fine of up to $500 per violation. Permits may be suspended or revoked for willful violations.
