Florida's Pool Safety Act (Fla. Stat. Ch. 515) requires every new residential pool, spa, or hot tub to have at least one of four safety features. FBC R4501.17 sets the technical specs. Broward Chapter 39 requires a 5-foot fence in residential districts.
Two layers of law govern Broward pool safety. State: Florida Statute 515.27 requires one of four features - a Section 515.29 barrier, an ASTM F1346 cover, exit alarms (UL 2017, 85 dBA at 10 ft) on doors/windows with direct pool access, or self-closing/self-latching doors with release at least 54 inches up. Section 515.29 requires the barrier be at least 4 ft (48 in) high outside, with self-closing self-latching gates opening outward. FBC Residential, 8th Ed. (2023) Section R4501.17 codifies these specs. Local: Chapter 39, applied in the BMSD, requires pools in any residential district be enclosed by a fence at least 5 ft high or an open-mesh screen enclosure - stricter than the state minimum.
Operating a residential pool, spa, or hot tub without a Section 515.27 safety feature is a second-degree misdemeanor. In the BMSD, missing the Chapter 39 fence or screen enclosure is a separate zoning violation enforceable by Broward Code Enforcement.
