FL Statute Β§791 regulates fireworks. HB 1059 (2020) legalized consumer fireworks on designated holidays: July 4, December 31, and January 1. Previously, a widely used βagricultural useβ exemption served as a loophole. Cities cannot ban fireworks on designated holidays but can regulate discharge hours and locations. Sparklers and novelty items available year-round. Professional displays require fire marshal permits. During burn bans, additional restrictions may apply.
