Consumer fireworks are legal in Broward County on July 4, Dec 31, and Jan 1 under FL §791.08 state preemption. Outside those dates, only sparklers and novelties are legal without a permit. The county cannot override this state law.
FL Statute §791 regulates fireworks. HB 1059 (2020) legalized consumer fireworks on designated holidays: July 4, December 31, and January 1. Previously, a widely used “agricultural use” exemption served as a loophole. Cities cannot ban fireworks on designated holidays but can regulate discharge hours and locations. Sparklers and novelty items available year-round. Professional displays require fire marshal permits. During burn bans, additional restrictions may apply.
