Florida permits sparklers and certain novelty items. Larger consumer fireworks are restricted under F.S. 791 with limited exceptions. Pembroke Pines enforces state fireworks laws.
Florida Statute Chapter 791 regulates fireworks. Sparklers and other novelty items (snakes, smoke devices) are legal year-round. In 2020, Florida legalized certain consumer fireworks (Roman candles, aerial devices) on specific holidays: July 4th, New Year's Eve/Day, and Memorial Day weekend (6 PM Dec 31–midnight Jan 1, 6 PM July 3–midnight July 5, 6 PM Saturday before Memorial Day–midnight Memorial Day). Outside these dates, fireworks use requires a legal purpose affidavit. Pembroke Pines enforces through its Fire and Police departments.
Using fireworks outside permitted dates without proper documentation is a first-degree misdemeanor with fines up to $1,000.
