Wichita enforces pool safety standards through the adopted International Residential Code (IRC) Appendix G and the Unified Zoning Code. All residential swimming pools deeper than 24 inches must be enclosed by a barrier at least 48 inches tall to prevent unsupervised access by children. Building permits are required for in-ground and above-ground pools.
Per IRC Appendix G as adopted by Wichita, residential pools, spas, and hot tubs holding water more than 24 inches deep must be surrounded by a barrier at least 48 inches in height measured from the outside. Gates must be self-closing and self-latching, with the latch located at least 54 inches above grade. Openings in the barrier may not allow passage of a 4-inch sphere. Where a wall of the dwelling serves as part of the barrier, doors leading to the pool area must be equipped with alarms or the pool must have a power safety cover meeting ASTM F1346. Pool equipment must comply with the Virginia Graeme Baker Pool and Spa Safety Act drain cover requirements. Pools must maintain setbacks from property lines and overhead electrical lines as specified in the Unified Zoning Code.
Operating a pool without required barriers can result in municipal court citations and fines. The Office of Central Inspection may order the pool drained or properly secured. Code violations may also create civil liability if a child is injured. Repeated noncompliance can lead to escalating fines and revocation of the pool permit.
