Effective July 1, 2019, Virginia became one of the earliest states to raise the minimum tobacco sale age to 21 through Code 18.2-371.2. The statute covers cigarettes, cigars, smokeless tobacco, hookah, liquid nicotine, vapor products, and nicotine pouches. Retailers must verify ID for any purchaser appearing under 30. Active duty military personnel 18 or older are exempt under state law. Distribution of free samples to minors is also prohibited. Health Department conducts compliance checks.
Selling to a buyer under 21 is a Class 2 misdemeanor and carries a civil penalty of up to $100 first offense, $200 second offense within 36 months, and $500 for subsequent violations. Repeat violators may face license suspension and additional administrative penalties.
