Kentucky law sets the minimum legal sales age for tobacco, vapor, and alternative nicotine products at 21 under KRS Β§438.305 (matching federal Tobacco 21). Louisville retailers must verify ID for any purchaser appearing under 30.
Under KRS Β§438.305, no person may sell or distribute tobacco products, vapor products, or alternative nicotine products to anyone under age 21. Kentucky raised its threshold to 21 to align with the federal Tobacco 21 law (Public Law 116-94, December 2019). Retailers in Louisville must check government-issued photo ID for any purchaser who reasonably appears to be under 30. The statute applies to cigarettes, cigars, smokeless tobacco, e-cigarettes, vape liquids, and synthetic nicotine. Louisville Metro Public Health & Wellness conducts compliance checks. Kentucky preempts most local tobacco licensing, but Louisville may enforce signage and operational rules.
Selling to a person under 21 is a violation with civil penalties starting at $100 for a first offense and escalating to $500 plus license-related sanctions for repeat retailer violations under KRS Β§ 438.313.
