Kentucky's tobacco and vapor regulation in KRS Chapter 438 is largely state-occupied, leaving little room for cities to impose stricter product-content rules such as menthol or flavor bans. Unlike California and Massachusetts, Kentucky has no statewide flavor restriction, and Louisville Metro Council has not attempted a local flavor ban. The Kentucky Department of Revenue's vapor directory (HB 11 of 2024) does, however, screen out products that fail to register or contain prohibited ingredients. Local public-health advocates have pushed for additional state-level action, but as of 2026 no Louisville flavor ordinance has been enacted.
There is no Louisville-specific flavor enforcement mechanism. State Tobacco 21 and directory violations are enforced through state penalties under KRS Β§ 438.313 and Department of Revenue licensing actions.
