New York Public Health Law Section 1399-mm-1 prohibits Westchester retailers from selling flavored e-liquids, pods, or vapor devices in any flavor other than tobacco. The ban covers fruit, mint, menthol vape, candy, dessert, and characterizing flavors that the Department of Health finds appeal to youth. Combustible menthol cigarettes are not currently banned at the state level, though federal FDA action and periodic state proposals could change that. Westchester County Code Chapter 833 imposes additional retail tobacco licensing requirements. Online and mail-order vape sales into New York must also comply. Enforcement is jointly handled by NYSDOH and county health departments.
