Maryland has not enacted a comprehensive statewide ban on all flavored tobacco products as of 2026, but federal law prohibits characterizing flavors in cigarettes other than menthol and tobacco. The Maryland General Assembly has considered flavored vape and menthol restrictions in recent sessions. Several jurisdictions, including Montgomery County, restrict flavored e-liquid sales to adult-only tobacco shops. Retailers must follow both state OTP licensing rules and any local flavor ordinances where applicable. The Comptroller and local health departments share enforcement.
