Texas regulates e-cigarettes and vapor products under TX HSC Chapter 161. Retailers must obtain a state retailer permit, prohibit sale to anyone under 21 except active duty military 18 or older, and post mandated signage about minimum age and youth tobacco prevention. Self-service displays are restricted and most products must be kept behind the counter or in locked cases. Bexar County itself has limited substantive control over vape retail beyond zoning of retail uses. San Antonio has business licensing for tobacco shops. Federal FDA premarket review applies to specific vape products. Synthetic nicotine and disposable flavored vapes have drawn additional state and federal attention but Texas does not impose a flavor ban.
