Live Oak prohibits accumulations of weeds, rank vegetation, and noxious plants on improved and vacant lots. The 12-inch cap and nuisance rules allow city abatement with lien under TX H&S Code 342.
Live Oak combines its weed and grass ordinance under Chapter 7 of the Code of Ordinances. Beyond the 12-inch maximum height rule, the ordinance prohibits accumulations of rank vegetation, noxious weeds, and invasive species that are considered public nuisances. Common target species in South Texas include Johnson grass, giant ragweed, Malta starthistle, and invasive bermudagrass encroachments. The ordinance applies equally to occupied residential properties, vacant lots, easements maintained by the owner, and commercial tracts. Enforcement follows Texas Health and Safety Code Chapter 342: owners receive written notice of violation with a 7 to 10 day cure window. If uncured, the city may mow, cut, or chemically treat the nuisance vegetation and assess the cost plus administrative fee as a lien. Native plant yards, wildflower meadows, and xeriscape gardens are allowed provided they are maintained and do not contain prohibited noxious species. Registering a naturalized landscape with Code Enforcement can prevent mistaken citations.
Unabated weed violations trigger city abatement plus lien and Municipal Court fines up to 500 dollars per day. Each day a nuisance persists is a separate offense under TX H&S 342.008.
