Oakland's tobacco retailer license program, in OMC Title 5, requires every store selling cigarettes, cigars, electronic cigarettes, or vape liquids to obtain and renew a city tobacco retailer license in addition to any state license. The ordinance limits new tobacco retailers near K-12 schools and youth-serving facilities, caps density in some neighborhoods, and prohibits self-service vape displays. Retailers must train clerks on ID checks for purchasers under 30, post required signage, and cooperate with compliance checks that test sales to underage decoys and verify the flavor ban.
License suspension, escalating fines, and revocation can follow underage sales, flavored product sales, or operating without a current city tobacco retailer license.
