Oakland Municipal Code Title 5 tobacco retailer rules prohibit the sale or distribution of flavored tobacco products at any tobacco retailer in the city, including menthol cigarettes, flavored cigars, flavored smokeless tobacco, and flavored electronic cigarette liquids. The Oakland ordinance, adopted in 2017, predated California Senate Bill 793, which voters affirmed in 2022 as Proposition 31 and which now imposes a similar statewide ban under Health and Safety Code 104559.5. Retailers must remove all flavored stock and are subject to compliance checks by Alameda County tobacco enforcement and Oakland Code Enforcement.
