Wichita vape and electronic-cigarette retailers must hold a Kansas Cigarette and Tobacco License from the Department of Revenue and follow KSA 79-3321 sales rules. Specialty vape shops also need a Wichita business license under Chapter 11.
Kansas requires every retailer selling cigarettes, electronic cigarettes, or vape products to hold a Cigarette and Tobacco License issued by the Kansas Department of Revenue under KSA 79-3302. The license must be renewed annually and posted at each retail location. Wichita additionally requires a city business license under Code of Ordinances Chapter 11 for the underlying business. The state recently expanded the registry of approved electronic cigarette products, requiring manufacturers to demonstrate FDA marketing authorization before products may be sold in Kansas. Wichita zoning does not impose dispensary-style buffer zones on vape shops, but signage rules apply.
Selling without a state tobacco license is a Class A nonperson misdemeanor under KSA 79-3321, plus fines and seizure. Selling unregistered electronic cigarette products incurs additional penalties under recent state law.
