California SB 1383 (Public Resources Code Β§42652+ and CalRecycle Title 14 CCR Β§18981+) requires every California jurisdiction to provide and enforce three-stream collection from residents and businesses; the City of Napa's SB 1383 program is administered jointly by the city's Solid Waste & Recycling Division and NRWS, with periodic 'flip-the-lid' route reviews for cart contamination. State law (14 CCR Β§18997.2) requires fines of $50-$100 first violation, $100-$200 second, and $250-$500 third within a 12-month period after notice and an opportunity to cure.
Failure to subscribe to NRWS service is a Chapter 5.60 violation citable through Code Enforcement under NMC Β§8.16.040 and the universal-service rule. SB 1383 contamination found during NRWS 'flip-the-lid' route reviews triggers a notice and an opportunity to cure; state-required minimums under 14 CCR Β§18997.2 are $50-$100 first violation, $100-$200 second, and $250-$500 third within 12 months. NRWS may refuse to service contaminated carts and leaves a courtesy tag. Leaving cans in the street more than 48 hours after collection is a property-related nuisance under NMC Β§8.16.040(F).
