Baldwin Park's Tree Preservation ordinance requires a permit from the Tree Officer to remove a Mature Tree (over 18 inches diameter or 40 feet tall) or a Required Tree on private property. Tree protection is codified in Zoning Code Subchapter 153.165 (Tree Preservation and Protection), which applies to every Public Tree, every Required Tree and every Mature Tree on private property (Section 153.165.020). The Community Development Department is the Tree Department, and a Tree Officer issues permits and makes removal determinations (Section 153.165.040). Under Section 153.165.090.A, no person may remove a Mature Tree or Required Tree on private property without first obtaining a permit from the Tree Officer. A 'Mature Tree' (Section 153.220) is a yard/setback tree greater than 18 inches in diameter measured 54 inches above ground, greater than 40 feet tall, or of historic value; a 'Required Tree' is one planted or preserved as a condition of a land-use approval. A permit is granted only on one of five findings: nuisance/hazard; disease or infestation threatening other trees; solar access under the Solar Shade Control Act of 1979; substantial inconvenience or financial hardship; or planting a suitable replacement within six months. The Tree Officer determines replacement size, species and location and may require relocation. All applications are reviewed by a certified arborist at the applicant's expense; decisions are appealable per Section 153.210.150 to the Tree Advisory Board (the Planning Commission). Public-tree work is reserved to the city. Exemptions include imminent hazards declared by police, LA County Fire or Public Works, normal pruning, and CPUC-mandated utility clearance (Section 153.165.100).
Removing a Mature or Required Tree without a Tree Officer permit, or injuring a Public Tree, violates Subchapter 153.165 and is enforced by Code Enforcement; administrative citations run $100 / $200 / $500 per violation, and replacement may be ordered.
