Hackensack requires a tree removal permit from the Building Department before removing trees with DBH of six inches or more on private property, or any street tree with DBH of 2.5 inches or more.
Under Chapter 162 (Trees), property owners or contractors must apply to the Building Department for a tree removal permit before removing covered trees. Any person removing one or more trees with a diameter at breast height (DBH) of six inches or more per acre is subject to permit and replacement requirements, unless an exemption under Section 162-9 applies. Street trees with a DBH of 2.5 inches or more always require a permit and replacement. The filing fee is $20 per application, plus a $350 per tree replacement fee paid at filing. Removal of any shade tree without permission from the City Manager is unlawful. The ordinance is administered with the Tree Division of the Department of Public Works.
Violators face a minimum fine of $100 per tree, with the Code authorizing fines up to $1,500 per illegally removed tree plus replacement costs.
