A property owner removing a tree entirely on private land ordinarily needs no City removal permit. Code Enforcement has stated it cannot require removal unless vegetation overhangs the public right-of-way or is dead and a fire hazard. Two exceptions can condition removal: larger projects with discretionary approvals may be required under Title 17 to retain or replace trees; and Chapter 8.40 requires removal of dead or diseased trees.
There is no penalty for removing an unregulated private tree. Enforcement applies to unauthorized removal or damage of City-owned parkway, median, park, or street trees, and to failure to remove dead or diseased trees required under Chapter 8.40.
