Brevard County Land Development Code Article XIII (Landscape, Tree Protection and Land Clearing) requires a permit to remove trees exceeding 8 inches DBH (diameter at breast height, 4.5 feet above grade). Specimen trees (24+ inch DBH) and historic/significant species require enhanced review. Protected species include live oak (Quercus virginiana), bald cypress (Taxodium distichum), southern magnolia, sand pine, and mangroves (red, black, white mangroves fully protected under FL Β§403.9321-9333 Mangrove Trimming & Preservation Act). Invasive species (Brazilian pepper, Australian pine, melaleuca) removal encouraged and exempt from permitting. Dead, diseased, or hazardous trees qualify for expedited permits. Right-of-way trees managed by Brevard County Public Works. HOAs often have additional approval requirements.
