Palm Bay Chapter 135 regulates fireworks. Consumer fireworks are prohibited except as permitted under FL Statutes 791.02, 791.04, and 791.07. Florida HB 1059 (2020) legalized consumer fireworks on July 4th, New Year's Eve, and New Year's Day. Sales from temporary locations are prohibited.
Under Palm Bay Code Chapter 135, it is unlawful to offer for sale, display, use, or explode fireworks within the city except as provided by state statute. The Fire Marshal develops affidavits for sellers to verify purchaser entitlement. Fireworks may not be sold from temporary locations. Purchasers for ceremonial events must provide evidence including a detailed description of the event. Florida HB 1059 legalized consumer fireworks on designated holidays (July 4, Dec 31, Jan 1), and cities cannot ban use on those days.
Unlawful use or sale of fireworks is a first-degree misdemeanor under Florida law, punishable by up to one year in jail and a $1,000 fine.
