Since August 2020, Palm Bay no longer requires building permits for non-masonry fences on single-family residential properties. A free zoning review by the Land Development Division is still required before installation, but no fees or inspections apply.
Palm Bay City Council passed an ordinance in August 2020 reducing fence permitting requirements. Wooden, plastic/vinyl, aluminum, chain link, and other non-masonry fences on single-family properties are exempt from building permits. A zoning review must be completed by the Land Development Division prior to installation at no cost and with no inspections. Masonry or concrete block fences and walls still require a full building permit. All fences must comply with Florida Building Code wind load requirements for the 130 mph wind zone.
Building a fence requiring a permit without one results in a stop-work order and a double permit fee plus a $100 administrative penalty. Non-conforming fences must be brought into compliance or removed.
