Titusville, FL Fence Regulations: Fence Permit Requirements (2026)

Section 6-56(c) of the Titusville Code of Ordinances, part of Chapter 6's building-permit article, states it is unlawful to construct any new fence or wall without first obtaining a permit from the building department. The section draws a line between simple upkeep and change: a repair or replacement of a permitted fence does not need a new permit if an approved permit record exists for the original fence and nothing changes in linear feet, materials, height or placement. Any alteration does require a new permit, whether or not a record exists, and the code lists change in material, linear footage, height or placement as alterations.

The permit itself follows the general application procedure in Sec. 6-57: a written application filed with the building official, made by the owner, lessee or their authorized agent, describing the proposed work. The building official reviews plans under Sec. 6-33 and may reject or approve them; unpermitted work can draw a stop-work order under Sec. 6-66, giving the owner 48 hours to apply for a permit once one is posted. The fence-permit rule was most recently amended by Ord. No. 25-2025, § 2, adopted July 22, 2025.

This building-permit requirement is separate from the zoning standards in Chapter 28 of the Land Development Regulations that set fence height and setback limits by district; a resident needs to satisfy both to build lawfully.
