Sec. 48 states plainly that a building permit is required for the construction of any fence or wall within the city, and that all requirements of the fence chapter and the City of Melbourne Building Code must be satisfied before the permit is issued. Sec. 49 then specifies what the application must contain: plans indicating the height, location and type of every fence or wall proposed, including any solid waste disposal receptacle screening required under Sec. 22, along with material specifications, methods of erection and supporting structural data.

All of this must be attached to either a stand-alone fence permit application or a building permit application before the city will review it. Because Sec. 48 cross-references the building code, a fence must also meet the wind-load and construction standards of Sec. 46, which requires all walls and fences to comply with the Florida Building Code. Once built, the fence must be kept in good repair under Sec. 50, and any request to deviate from the article's standards goes to the board of adjustment as a variance under Sec. 51, following the procedures in Appendix B, Article IX, Section 7 of the City Code.
