Union City requires a Public Works tree permit to remove or trim a significant tree under UCMC 12.16.170. Residential trees of 35-inch circumference and commercial/vacant trees of 12-inch circumference are protected, with replacement-value penalties.
Union City operates a genuine tree-preservation permit program in UCMC Chapter 12.16. Section 12.16.170(C) makes it unlawful to trim or remove a covered tree without a permit. Covered trees are residential trees of 35-inch trunk circumference or more (or multi-trunk totaling 70 inches); 12-inch-circumference trees on commercial, industrial, or vacant property; and trees subject to a zoning or subdivision approval (§12.16.170(B)), measured three feet above ground. Applications go to the Public Works Director, who weighs §12.16.170(G) standards — tree condition and hazard, erosion and drainage effects, neighborhood character, and parcel carrying capacity — and may grant, deny, or condition the permit, including requiring replacement trees at the applicant's cost (§12.16.170(F)). For projects before the Planning Commission, it decides the permit
Violations are nuisances the City may abate or enjoin (UCMC §12.16.200(A)). The City may impose the tree's comprehensive replacement value under the ISA Guide for Valuation of Landscape Trees (§12.16.200(B)), require replacement trees, and pursue cumulative remedies (§12.16.210).
