When development drops a Fayetteville site below its minimum canopy, Chapter 167 requires mitigation. Replacement is forested by base density, and if trees cannot be planted on-site, the developer pays $675 per tree into the city Tree Escrow Account.
Under Section 167.04, developments that fall below the required canopy must compensate through on-site mitigation, off-site alternatives, or payment. All planted trees must be region-native species from the Landscape Manual's preferred list. On-site mitigation is preferred and can earn up to a 20% reduction in trees required. When planting is infeasible, the developer pays into the Tree Escrow Account at $675 per tree, and that money must be spent on planting within seven years.
Failing to complete required mitigation or escrow payment can block Final Plat approval or the Certificate of Occupancy until the obligation is met, alongside the general penalty under Section 10.99.
