Fayetteville protects notable trees through a voluntary Tree Registry, not a mandatory heritage-tree law. Owners can register trees of historic merit, rare species, or extraordinary age, size, or type; registration is optional and does not bind future owners.
Section 167.03 establishes the City of Fayetteville Tree Registry. Trees or groups of trees documented to be of historic merit, of an uncommon or endangered species, or of extraordinary value due to age, size, or type may be registered. The Landscape Administrator maintains the Registry. Registration is voluntary and is done by the property owner; it does not run with the land unless the owner creates an express trust conveying an interest in the tree to the city. Registered owners receive consultation from the Tree and Landscape Advisory Committee on care and protection. Unlike some cities, Fayetteville does not fine owners for removing their own registered tree.
There is no penalty for removing a voluntarily registered tree on private property, since registration does not restrict the owner. Damaging trees in a recorded development Tree Preservation Area, however, requires Landscape Administrator approval.
