Federal Way uses a tree unit credit system rather than a one-to-one replacement count. Under FWRC 19.120.130, existing significant trees retained on site count for multiple tree units depending on their diameter, while newly planted replacement trees count as a single tree unit each. Replacement trees must be a minimum of 1.5-inch caliper for deciduous and 6 feet tall for evergreen, per FWRC 19.120.130(4). When on-site replacement is infeasible, FWRC 19.120.140 allows the director to approve off-site planting or a fee-in-lieu deposited into the city's urban forestry account.
Failure to plant required replacement trees or to satisfy mitigation conditions is a civil code violation under FWRC Chapter 1.15, with monetary penalties and the potential for permit revocation.
