Newport News does not levy a dedicated ADU impact fee because Chapter 45 of the City Code has no general by-right ADU framework. Water service is provided by Newport News Waterworks, a regional utility serving Newport News, Hampton, Poquoson, James City County, and York County; new water connections trigger Waterworks availability fees only if a separate meter is set. Wastewater conveyance and treatment is provided through Hampton Roads Sanitation District (HRSD), which assesses its own facility (capacity) charges on new connections. Cash proffers may be conditioned on a rezoning, subject to the strict limits in Virginia Code sections 15.2-2298 and 15.2-2303.4, which restrict residential rezoning proffers. Road impact fees under Virginia Code section 15.2-2317 et seq. apply only where the City has formally adopted them in a designated impact-fee service area, which Newport News has not generally done for residential infill.
Failure to pay required permit, plan-review, and utility connection fees blocks issuance of building permits and prevents lawful construction in Newport News. Unauthorized HRSD or Waterworks tap-ins discovered later result in disconnection, back-billing, and code enforcement. Proffers attached to a rezoning are enforceable as zoning conditions; breach can support enforcement under Virginia Code section 15.2-2209 with daily civil penalties of up to $1,000 for repeat violations.
