Newport News City Code Chapter 13 adopts the Virginia Uniform Statewide Building Code (USBC), which incorporates the International Building Code (IBC). Under the USBC and IBC Section 1807, retaining walls that retain more than 4 feet of unbalanced soil fill (measured from the bottom of the footing to the top of the retained material) require a building permit and structural drawings prepared and sealed by a licensed Virginia professional engineer. Walls 4 feet or under may be constructed without a permit but must still be structurally sound and must not encroach into drainage easements, rights-of-way, or required setbacks per the Zoning Ordinance (Chapter 45).
