Cal. Gov. Code §66322 overrides Redding's standard development impact fees (water, wastewater, traffic, parks, fire) for qualifying ADUs. An ADU below 750 sq ft pays zero impact fees - the city cannot charge any local development or capacity fee in that size class. ADUs at or above 750 sq ft must be charged proportional fees based on size relative to the primary dwelling. Building-permit and plan-check cost-recovery fees remain payable, as do dedicated new-service utility connection fees. School fees under Ed. Code §17620 follow the proportional structure.
Charging impact fees on an ADU under 750 sq ft, or charging disproportionate fees on a larger ADU, violates Cal. Gov. Code §66322 and is recoverable by the applicant. State law preempts any conflicting local fee schedule.
