Long-term rental of a Raleigh accessory dwelling is allowed under UDO Section 6.7 without a separate business license. Short-term rental (under 30 days) requires a Short-Term Rental Zoning Permit under UDO Section 6.7.A.5 and Raleigh Code Section 12-3027, adopted in 2018 after the Schroeder v. City of Wilmington line of cases. A zoning permit costs an annual fee (see Raleigh fee schedule), and operators must collect and remit Wake County Occupancy Tax (3 percent) and NC sales tax. Whole-house STRs (Type 2, non-owner-occupied) are limited to 3 unrelated guests per bedroom and must comply with safety inspections. The ADU itself can be the STR unit if registered, but Type 2 ADU STRs are subject to neighborhood spacing requirements under UDO Section 6.7.A.5.
Operating an unpermitted STR violates UDO Section 6.7.A.5 with administrative citations up to $500 per day under NC Gen. Stat. 160D-404. Repeat violations result in permit revocation and Wake County tax enforcement.
