North Carolina adopts the International Fire Code as the State Fire Prevention Code (12 NCAC 03 and the 2018 NC Fire Prevention Code based on the 2018 IFC). Section 308.1.4 prohibits open-flame cooking devices on combustible balconies, decks, or within 10 feet of combustible construction in buildings with three or more dwelling units (R-2 occupancies). LP-gas containers (propane) are limited to 1 pound water capacity or less on such balconies; standard 20-pound BBQ tanks are prohibited. Exceptions apply where the building is protected throughout by an automatic sprinkler system, where the cooking device is listed and labeled for the use, or where the balcony or deck is constructed of noncombustible materials. Single-family homes with detached patios may use full-size BBQs, with a recommended 10-foot clearance from combustible structures.
