Cary enforces the 2018 North Carolina Fire Prevention Code (NCFC) Section 308, which prohibits charcoal burners and open-flame cooking devices on combustible balconies or within 10 ft of combustible construction at multi-family buildings. LP-gas cylinders over 2.5 lb water capacity are prohibited within 10 ft of combustible construction. One- and two-family dwellings and fully sprinklered buildings are exempt. The Cary Fire Department enforces.
Cary adopts and enforces the North Carolina State Building Code: Fire Prevention Code (NCFC, 2018 edition) through Cary's Code of Ordinances and the Cary Fire Department Fire Marshal's Office. NCFC Section 308.1.4 prohibits charcoal burners and other open-flame cooking devices from being operated on combustible balconies or within 10 ft of combustible construction in multi-family buildings (apartments, condos, townhouses sharing walls). NCFC Section 308.1.4.1 prohibits LP-gas cylinders or containers with a water capacity greater than 2.5 lb from being stored or used on the balcony or within 10 ft of combustible construction. A standard 20-lb propane cylinder vastly exceeds the 2.5-lb threshold. Exceptions: (1) one- and two-family dwellings - Cary homeowners may grill on porches, patios, and decks without the 10-ft setback; and (2) buildings, balconies, and decks protected by an automatic fire sprinkler system. Electric portable tabletop grills are permitted on balconies. Cary Fire Department conducts complaint-driven inspections in multi-family complexes and works with property management to enforce. Many Cary apartment communities (Park West Village, Amberly, Bradford, etc.) post their own enforcement notices.
