Brazoria County cannot zone livestock out of the unincorporated area. A local-option stock law can require fencing so animals do not run at large, and the Texas Right to Farm Act shields established agricultural operations from nuisance suits.
Raising cattle, horses, hogs, sheep, or goats on unincorporated land is not limited by county zoning, which the county has no power to enact. Two state frameworks matter. First, Agriculture Code Chapter 143 stock laws, once adopted by local election, bar owners from letting the named animals run at large. Second, the Texas Right to Farm Act (Agriculture Code Chapter 251) protects an agricultural operation that has run lawfully and substantially unchanged for one year or more from nuisance actions by newer neighbors. Inside a city, the municipal code may restrict where livestock can be kept.
Animals running at large under a stock law can be impounded as estrays and the owner held liable for damages. A barred nuisance plaintiff may owe the operator defense costs and attorney's fees under Sec. 251.004.
