The NRH Zoning Ordinance (Code of Ordinances Appendix A) sets maximum structure height by district. Accessory structures such as detached garages and storage buildings are limited to 16 feet in most residential zones. Multifamily districts (R-6-T, R-7-MF, R-8) allow up to 45 feet. Commercial districts (C-1, C-2) typically allow 35 to 50 feet, while the Town Center TOD district permits taller mixed-use buildings subject to transition height requirements when adjacent to single-family areas. Antennas, chimneys, church steeples, water tanks, and mechanical penthouses may exceed district limits if they do not constitute usable floor area. Planned Development (PD) districts may establish their own height standards through the ordinance approving the PD. Height variances require a Zoning Board of Adjustment hearing and proof of hardship unique to the property.
Construction exceeding district height limits without a variance is a Class C misdemeanor with fines up to 2,000 dollars per day under Texas Local Government Code Chapter 211 and NRH Code Section 1-7.
