Under NY Marihuana Regulation and Taxation Act (MRTA, Cannabis Law Β§222), effective 2021, Bronx residents 21+ may grow up to 3 mature and 3 immature cannabis plants at home, with a household cap of 6 mature and 6 immature. Plants must be out of public view and secured from minors.
Home cultivation became legal when adult-use sales commenced (December 29, 2022). Plants must be grown on the grower's primary residence and cannot be visible from a public place. Landlords may restrict cultivation in leases. NYCHA (public housing) prohibits cannabis under federal law. Sale of home-grown cannabis is prohibited under Cannabis Law Β§132.
Over-limit: civil penalty up to 125 dollars per excess plant (first offense). Sale of home-grown: Class A misdemeanor.
