Licensed cannabis dispensaries in the Bronx operate under NY Office of Cannabis Management (OCM) rules. Dispensaries must be at least 500 feet from a school or 200 feet from a house of worship. NYC did NOT opt out of retail sales, so dispensaries are allowed in commercial zones throughout the Bronx.
Under MRTA, municipalities had until December 31, 2021 to opt out of adult-use retail. New York City did not opt out, so all five boroughs including the Bronx permit OCM-licensed dispensaries. NYC zoning allows dispensaries in C1, C2, C4, C5, C6, C8, and M zones. Several dispensaries have opened in the Bronx since 2023, including in Fordham and Hunts Point. Unlicensed shops are subject to OCM padlock orders under Cannabis Law ยง16-a.
Unlicensed sales: OCM padlock plus civil penalties up to 20,000 dollars per day. Zoning violations: DOB fines up to 25,000 dollars.
