The Illinois Cannabis Regulation and Tax Act (410 ILCS 705) legalized recreational cannabis but does NOT allow recreational home cultivation. Only registered medical cannabis patients may cultivate up to 5 plants at home for personal use under the Compassionate Use of Medical Cannabis Program Act (410 ILCS 130). Plants must be in a locked, enclosed area not visible or accessible to anyone under 21. Cultivation must be on the patient's own residential property with the owner's permission. Cook County follows state law on cannabis cultivation. The county does not impose additional restrictions beyond state requirements. A cannabis cultivator must obtain the permission of the residential property owner before commencing cultivation. Landlords may prohibit cultivation in lease agreements.
