The City of Schenectady enforces a juvenile curfew under City Code Chapter 138 restricting minors under 17 from public places during overnight hours. Most towns in Schenectady County (Rotterdam, Niskayuna, Glenville) do not have formal juvenile curfews.
City of Schenectady Code Chapter 138 (Curfew) prohibits minors under 17 from being in public places, on public property, or in business establishments between 11:00 PM and 6:00 AM Sunday through Thursday, and between midnight and 6:00 AM on Friday and Saturday. Exceptions apply when the minor is: accompanied by a parent or guardian; traveling directly to/from lawful employment; attending or traveling from a school, religious, or municipal event; responding to an emergency; or exercising First Amendment rights. Parents who knowingly permit curfew violations can also be charged. Police officers who encounter violators take them home or to a designated holding location until a parent responds. Towns of Rotterdam, Niskayuna, and Glenville rely on state laws (Family Court Act, Penal Law) rather than local curfews. The NY Family Court Act governs PINS (Persons in Need of Supervision) proceedings for habitual offenders.
Minor: initially taken home or to parent; repeat offenders referred to Family Court as PINS. Parents knowingly allowing violation: $100-$250 fine under Ch. 138. No criminal record for curfew-only violations.
