ORS 419C.680(1) makes it unlawful for any minor to be in or upon any street, highway, park, alley, or other public place between midnight and 4:00 a.m. unless the minor is accompanied by a parent, guardian, or other person 18 years of age or over and authorized by the parent, is engaged in a lawful pursuit that requires their presence, or is emancipated under ORS 419B.550-419B.558. ORS 419C.680(2) extends liability to parents and guardians who allow the violation. Troutdale's Municipal Code does not contain a stricter local curfew chapter, so officers cite the state statute. Violators may be taken into custody under ORS 419C.080, 419C.085, and 419C.088.
ORS 419C.680(3) authorizes police to take violating minors into custody. The case proceeds in juvenile court under ORS Ch. 419C. Parents who allow violations face separate liability under subsection (2) of the same statute.
