Federal law preempts state and local airspace regulation (FAA Reauthorization Act of 2018, Title V). However, the City of Ventura regulates ground-based filming and use of city facilities: commercial filming on city property, including aerial filming launched from a city park, sidewalk, or city right-of-way, generally requires a Film Permit issued by the City Manager's office. Filming in the California Coastal Zone may also need a Coastal Development Permit or Coastal Commission concurrence. Cal. Pen. Code §402 (drones interfering with emergency operations) and Cal. Civ. Code §1708.8 (drone privacy) apply equally to commercial operators, with the privacy statute including disgorgement of any commercial gain. Operators carrying passengers or cargo for hire must hold additional FAA economic authority.
FAA enforcement up to $27,500 civil / $250,000 criminal per violation (49 U.S.C. §46301). Operating commercially without a Part 107 certificate is itself a violation. Filming on city property without a film permit subject to enforcement under SBMC park and street use rules. Civ. Code §1708.8 allows disgorgement of commercial proceeds in addition to treble damages and $5,000–$50,000 fines.
