Louisiana law prevents parishes and municipalities from compelling private employers to provide paid sick leave, vacation, or other employee benefits beyond state and federal requirements.
La. R.S. 23:642 expressly preempts local ordinances that require private employers to provide vacation time, sick leave, or other employment benefits. Louisiana has no statewide paid sick leave law, so leave benefits remain a matter of employer policy or contract. Federal Family and Medical Leave Act protections still apply to qualifying employers. Public employees may receive leave under separate civil service rules, which are unaffected by the preemption.
Local paid leave ordinances applied to private employers are void; affected employers may obtain injunctive relief and recover litigation costs in some cases.
