Hoboken, NJ Environmental Rules: Erosion Control (2026)

Section 166-4A of Hoboken's stormwater management ordinance requires that stormwater management measures for major development provide erosion control, groundwater recharge, runoff quantity control and runoff quality treatment. Subsection A(1) sets the erosion standard by adopting the state's minimum standards outright: those established under the Soil Erosion and Sediment Control Act, N.J.S.A. 4:24-39 et seq., and the implementing rules at N.J.A.C. 2:90. The article applies only to nonresidential major developments and to the non-preempted aspects of residential major developments in the zoning districts mapped W(RDV), W(N) and I-1(W), and to any major development the City of Hoboken itself undertakes in those districts, per § 166-2C.

One stated purpose of the chapter, set out in § 166-1, is to reduce soil erosion from any development or construction project alongside flood damage reduction and groundwater recharge. Variances from the design standards, including the erosion requirement, may be granted only if the conditions at N.J.A.C. 7:8-4.6(a)1 and 2 are met, cannot be issued for a condition the applicant created, sit at the discretion of the City Engineer, and must be reported annually to the New Jersey Department of Environmental Protection under § 166-13.
