Hoboken, NJ Fence Regulations: Fence Permit Requirements (2026)

City Code § 168-36 authorizes the Zoning Officer to grant revocable licenses, renewable at five-year intervals, to property owners for erecting or maintaining new fences, gates or stairways upon any street, sidewalk or public easement in Hoboken. Issuance is conditioned on the owner filing a certificate of liability insurance of at least $100,000, naming the Mayor and Council of the City of Hoboken as coinsured, kept in force during erection of the fence and afterward; owner-occupied one- and two-family homes are exempt from this insurance requirement.

If a licensee fails to maintain the required insurance, the owner must remove the encroachment, and if the owner refuses, the Zoning Officer removes it and charges the cost to the owner. Under § 168-39, the Zoning Officer promulgates implementing rules and collects a flat $20 fee per license application. Section 168-40 grandfathers fences, gates and stoops built on or before January 1, 1981 from needing a license at all, though any later alteration, addition or modification to them falls back under these licensing rules.

Applications for premises inside a historic district or a designated historic site cannot be approved under § 168-43 without first clearing the Hoboken Historic Preservation Commission, referencing Chapter 42 of the City Code. The City separately reserves the right under § 168-42 to demand removal of any fence, gate or stoop that is improperly constructed or maintained, regardless of licensing status.
