Hoboken, NJ Parking Rules: Street Parking Limits (2026)

Section 190-41.1, added January 17, 2007 by Ordinance No. DR-288 and amended October 20, 2010 by Ordinance No. Z-63, lets the Director of the Hoboken Parking Utility issue permits under N.J.S.A. 39:4-138.4 to owners of private driveways, or to members of the same household at a private residence, authorizing a private passenger vehicle to park in front of that driveway. An owner may hold up to three permits for personal vehicles or for others the owner authorizes; each vehicle-owning household member at a private residence may also apply.

The Director can require proof the driveway was legally established under the city's Zoning Code. The permit must name the driveway location and the authorized vehicle, measure 5 1/2 by 8 1/2 inches, carry a certification of authenticity, and be displayed prominently so it can be read from the middle of the street. No owner may charge a fee for letting someone park in front of their driveway, and no permits issue for multiuse or connecting driveways. The parked vehicle itself must sit parallel to the curb and must never block sidewalk access.

Holding a valid permit is an affirmative defense to a driveway-obstruction charge under N.J.S.A. 39:4-138(d) when the parked vehicle and driveway share an owner, belong to the same household, or the driveway owner authorized the specific vehicle; a sworn affidavit under Court Rule 7:6-6(a) can support that defense. Section 190-44's chapter-wide penalty schedule sets the fine for prohibited parking at all times under § 190-3 at $50, and Hoboken can tow any vehicle from a marked tow-away zone regardless of whether the specific code section it violated calls for towing.
